Writing a demand letter (Ontario, Canada)
i am SO sorry for length of this post. you can skim over it, to get a general idea.
To make a long story short, here's a small time line of events to help give a picture:
April 2023: bought a used car, as is. knew it needed work. Talked with the mechanic (Mechanic A) my parents had been using and he said he could do the work.
May-June 2023: They got the car, and worked on it for nearly two months. Was always given the run around (never responded to my calls, wouldn't tell me where my vehicle was, would say "xyz was done today" but when I'd call back a week later the story would change and be "we still haven't done xyz"). Upon picking up car, they warned me a wheel bearing was bad and going to do, but completely save to drive.
Late June 2023: contacted MTO, advised to see another mechanic (Mechanic B) to assess the vehicle and determine if it would pass safety. Bought in the follow day, mechanic found 10 concerns that would each cause it to fail a safety.
July 2023: MTO officer came and looked at vehicle, agreed with mechanic b that vehicle was not safe. MTO officer visited mechanic a to inform him of the issues, give him fines, etc. MTO officer informed me same day mechanic a would contact me to discuss how they would fix the issues.
August 2023: Mechanic a did not contact, so I went down to his shop with my mother and we discussed what I felt was fair for the situation. We came to the agreement that he would pay for the repairs, we agreed on mechanic, and we assumed that would be that.
some work was done after this conversation, with his consent, and he took nearly two months to pay the bill. mechanic a was aware not all work had been completed.
February 2024: I took my car through a car wash and the paint began to come off my bumper (was brand new and painted in May/June 2023, bumper was around $300-400, paint was $970) so I went back to mechanic a. Mechanic a took it to get painted and I was aware there was a warranty on the paint job. He agreed it shouldn't do that, and would get it booked in. He said it would take 3 days and suggested i find a time that worked best as he had no rentals. He also said they'd finish the remaining work (new front bumper, polish headlights, and properly attach bumper, as it was attached with zip ties) so it would be done with.
April 2024: I found a week that worked well and booked it in. Called to get an update as he said he might have a rental within a day but to call in ask. When I called, I was informed my vehicle was with "Sam" (name changed) and I knew Sam didn't work for Bodywork (where the warranty was originally was, again name changed) as he had done work on my vehicle back in May, at a different location. I walked down to Sams shop where we confirmed my vehicle was. Again, not at Bodywork where warranty was.
Upon picking up my car, it was making an awful noise in the back end, lots of squeezing that wasnt there prior. Took it into a car wash thinking possibly it was a rock or something suck in a weird spot (recommended by mechanic b). noise continued. went back to mechanic a to ask what happened. Before we could even explain the noise he said "we did nothing!". He took a quick look at it, claimed it was a bushing, and not anything they did. I nicely said it couldn't be, as my car had been at mechanic b the week before and all was good. He began to scream, calling me slurs among other names.
Mechanic B took a look a few days later and determined something was wrong with the bumper. Mechanic C (needed two quotes) determined the brackets on one side are completely missing hence the noise and now why my bumper is falling off.
I also noticed the rear bumper is not the correct colour (bumper is white and my car is a pearl white, doesn't sound like a big difference but when the two are together you can see it)
May 2024: I noticed the paint on the front bumper has already begun to peel off.
I have gotten two quotes for the bumper repair, and another on the chipping paint. Legal aid requested I put together a demand letter, but wasn't able to help me with it. Can anyone provide me with tips or suggestions on what to include, how I should send it (mail, email, etc), and anything else that might be helpful?
This has been a nightmare and I feel like he just keeps thinking he can screw me over. Hopefully this will be over soon.
