Seeking advice and self experiance - Buying first home for self use , currently tenanted and seller will use n12 for eviction ( purchaser self use )
I m planning to buy a property in ontario with Tenents in i for self use . I want to understand if the eviction goes to LTB what are the chances and conditions where that eviction can't happen and we loose the case . Here is our situation. 1)Property is discounted because of tenant living in it and probably not willing to leave easily. 2)Seller agent told us that they are not ready to do N11 cash for keys , not sure why but may because the ask could be big or tenant not ready to leave that easy . 3) seller wants that the closing keep getting extended every 30 days untill eviction finally happens . 4) seller agrees to do repairs if tenant thrashes the property. 5) buyer/ myself can't assume the tenant as I m first time homebuyer and putting less than 20% down , banks won't allow mortgage with tenants in it. 6) buying this property for self use and seller will give n12 to tenant for eviction . I understand that if I do this deal closing might stretch to 8 - 12 months givin tenant fights back in ltb. I am ready for this wait because i m getting it at a good price and house checks all my boxes and I m in no hurry to move. However I don't want that after all the wait the tenant wins the case and since I would have already committed to buying where I will stand legally, will I be waiting forever ? Anyone with similar experiance in ON and how long it took for you to get tenants evicted ? So want to understand under what circumstances tenent can win and what legal clauses i should be keeping in the sale aggrement to protect myself as a buyer ? ( can't keep a fix closing date and can't backout once eviction starts that what seller wants ) Screenshot of the current clause that we had for the offer .
